1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Kairos Digital Labs LLC ("Kairos Digital Labs," "we," "our," or "us"), a Delaware limited liability company, governing your access to and use of our website located at kairosdigitallabs.com (the "Site").

By accessing or using the Site, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree to these Terms, you must not access or use the Site.

These Terms apply to the Kairos Digital Labs corporate website only. Our individual companies and applications — Maritime Burials, EWIG (Every Where I Go), Death Doula Directory and Never Lose the End — are governed by their own separate terms of service.

2. About Kairos Digital Labs

Kairos Digital Labs LLC is the parent company of Maritime Burials, EWIG (Every Where I Go), Death Doula Directory and Never Lose the End. The name "Kairos" (Ancient Greek: καιρός) means "the exact or critical time" — the opportune moment. Our mission is to build intelligent applications that understand and serve the human experience at its most personal and universal.

The Site is an informational corporate website providing information about our company, our products, and our mission.

3. Intellectual Property

3.1 Our Content

The Site and all of its content, features, and functionality — including but not limited to text, graphics, logos, images, icons, design elements, the Kairos wordmark, the Kairos monogram, the names "EWIG," "Maritime Burials," "Death Doula Directory," and "Never Lose the End," the taglines "Plan. Connect. Go. Remember." and "Your travels, alive." and all sacred geometry and visual brand elements — are owned by Kairos Digital Labs LLC or our licensors and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

3.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial informational purposes only. This license does not include:

  • Copying, reproducing, or distributing any content from the Site
  • Modifying, adapting, or creating derivative works from Site content
  • Using any Kairos branding, logos, or trademarks without our prior written consent
  • Scraping, data mining, or automated extraction of Site content
  • Commercial use of any content from the Site

3.3 Trademarks

"Kairos Digital Labs," "EWIG," "Every Where I Go," "Maritime Burials," "Death Doula Directory," "Never Lose the End," the Kairos DK monogram, and associated logos and taglines are trademarks or trade dress of Kairos Digital Labs LLC. Nothing in these Terms grants you any right to use our trademarks without our prior written permission.

3.4 Feedback

If you submit ideas, suggestions, or feedback to us regarding the Site or our products, you grant us a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, modify, and incorporate that feedback into our products without any obligation or compensation to you.

4. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, local, or international law or regulation
  • Transmit any unsolicited or unauthorized advertising or promotional material
  • Impersonate or attempt to impersonate Kairos Digital Labs, a Kairos employee, another user, or any other person or entity
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
  • Use the Site to transmit any material that is defamatory, obscene, offensive, hateful, or otherwise objectionable
  • Introduce any viruses, trojan horses, worms, or other malicious code
  • Attempt to gain unauthorized access to any portion of the Site or any systems connected to the Site
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose
  • Use the Site in any manner that could disable, overburden, damage, or impair the Site

The Site may contain links to third-party websites, including the Apple App Store, Google Play Store, and our individual application websites (maritimeburials.com, ewig.ai, deathdouladirectory.com and neverlosetheend.com). These links are provided for your convenience only.

We have no control over the content, privacy policies, or practices of third-party websites. We do not warrant or make any representation regarding the accuracy, completeness, or reliability of third-party content. Your access and use of any third-party website is at your own risk and subject to that website's own terms and policies.

The inclusion of any link on our Site does not imply endorsement, sponsorship, or recommendation of the linked website or its operators.

6. Disclaimers

6.1 No Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KAIROS DIGITAL LABS EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, timely, secure, or error-free
  • The results that may be obtained from use of the Site will be accurate or reliable
  • Any errors in the Site will be corrected

6.2 No Professional Advice

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL KAIROS DIGITAL LABS LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

8. Indemnification

You agree to defend, indemnify, and hold harmless Kairos Digital Labs LLC and its members, managers, officers, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Site in any manner not expressly authorized by these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit to us through the Site

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to our collection and use of your information as described in the Privacy Policy.

10. Modifications to the Site and Terms

We reserve the right to modify, suspend, or discontinue the Site or any part of it at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Site.

10.2 Changes to These Terms

We may revise these Terms at any time by updating this page. The "Last Updated" date at the top of this page will reflect when changes were made. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms and any dispute arising out of or related to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2 Jurisdiction

You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

11.3 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at support@kairosdigitallabs.com and attempt to resolve the dispute informally for a period of thirty (30) days.

11.4 Waiver of Class Action

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST KAIROS DIGITAL LABS.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kairos Digital Labs regarding the Site and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. A waiver of any provision will only be effective if in writing and signed by an authorized representative of Kairos Digital Labs.

12.4 No Agency

Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and Kairos Digital Labs.

12.5 Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, civil unrest, labor disputes, or internet or power outages.
